1. These terms

These Terms of Use govern your access to and use of onlinelegalhelp.org and any associated enquiry form, email address or WhatsApp channel operated by Swapraxis LLP, (“we”, “us”, “the Platform”).

By using the website you accept these terms. If you do not accept them, do not use the website.

2. Who may use this website

  • You must be 18 years of age or older.
  • If you are using the website on behalf of an organisation, you confirm you are authorised to bind it.
  • The website is directed at users in India and is written to Indian law. We make no representation that the content is appropriate or lawful in any other jurisdiction.

3. What this website is

The website publishes general legal information and provides a channel through which you may send us an enquiry. It is not a law firm, does not provide legal advice, does not provide legal representation, and does not advertise or endorse any advocate. The Disclaimer & Regulatory Notice forms part of these terms and should be read with them.

4. Acceptable use

You agree that you will not:

  • use the website for any unlawful purpose, or to further any offence;
  • submit information that is false, misleading, or that impersonates another person;
  • submit material that is defamatory, obscene, threatening, or that infringes a third party’s rights;
  • publish, transmit or seek from us any material the disclosure of which is restricted by an order of a court or tribunal, including material subject to an in-camera direction or a reporting restriction;
  • copy, scrape, mirror, republish or commercially exploit our content except as permitted in clause 6;
  • attempt to gain unauthorised access to the website, its servers, or any data held on them, or introduce any malicious code;
  • use automated means to submit enquiries or to place load on the website.

5. Enquiries you send us

  • An enquiry is a request for general information. It does not engage us or any advocate, and it does not create any professional relationship.
  • You are responsible for the accuracy of what you tell us. We act on the facts as you state them.
  • Do not send confidential, privileged or sensitive documents. If you do, you accept that no professional privilege attaches to them.
  • We may decline to respond to any enquiry, and we are not obliged to give reasons.
  • Nothing in an enquiry or in our response extends, suspends or interrupts any limitation period.
  • By sending an enquiry you grant us a limited, non-exclusive licence to store and process it for the purposes set out in our Privacy Policy, and nothing more.

6. Intellectual property

All content on this website — text, structure, layout, graphics, illustrations and code — is owned by Swapraxis LLP or licensed to it, and is protected under the Copyright Act, 1957. Bare text of statutes, rules and judgments is not claimed; our arrangement, commentary, translation and explanation of them is.

You may read, print and share individual pages for your own personal, non-commercial use, with attribution and without alteration. You may not republish our content on another website, in a course, in a document sold for a fee, or as training input to a commercial product, without our prior written permission.

7. Availability

We aim to keep the website available but do not guarantee uninterrupted access. We may modify, suspend or withdraw any part of the website, or any page of content, at any time and without notice.

8. No warranty

The website and its content are provided on an “as is” and “as available” basis. To the extent permitted by law, we exclude all warranties, express or implied, including as to accuracy, completeness, currency, fitness for a particular purpose, or applicability to your matter.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any loss arising from your use of, or reliance on, this website — including any loss of a right or remedy, any adverse order, any expiry of limitation, any lost opportunity, or any indirect or consequential loss.

10. Indemnity

You will indemnify us against any claim, loss or expense arising from your breach of these terms, your misuse of the website, or your submission of unlawful or infringing material.

11. Suspension

We may restrict or block your access to the website or to our enquiry channels if we reasonably believe you have breached these terms, are misusing them, or are placing abusive or automated load on them.

12. Changes

We may amend these terms. The amended version takes effect when published on this page with a revised “last updated” date. Continued use after that date is acceptance.

14. Severability

If any clause is held unenforceable, it is severed and the remainder continues in force.
